JUSTICE SUDHIR SINGH ORAL ORDER 04-10-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 324, 307 and 34 of the Indian Penal Code and 27 of Arms Act.
The case of prosecution, in short, is that on 08.05.2013 the informant was sleeping at his door along with his brother. At about 3 A.M. night some persons came there and fired over the informant and the informant became injured by that bullet and blood was oozing and informant's brother Mukesh Sadai also injured. On hulla so many peoples came there and brought the injured at hospital.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 09.03.2015. Charge sheet has been submitted in this case. There is no allegation of tampering with the
Patna High Court Cr.Misc. No.29217 of 2016 (4) dt.04-10-2016 2/2 witnesses alleged against the petitioner. The petitioner is not named in the FIR. No specific overt act has been alleged against the petitioner.
On behalf of the State, it is submitted that the petitioner is not named in the FIR.
Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Madhubani in connection with Bheja P.S.Case No. 52 of 2013,G.R.No. 515 of 2013.
