Petitioners apprehend their arrest in a case registered for the offence punishable under Section 304(B), 302, 506 of the Indian Penal Code.

As per prosecution case petitioner No.1 is alleged to have put kerosene oil on the body of informant (deceased) and set her on fire. Petitioner No.2 is alleged to be order giver. Learned counsel appearing for the petitioners submits that petitioner No.1 is mother-in-law of the deceased and petitioner No.2 is her father-in-law. There is general and omnibus allegation against these petitioners.

No.67747 of 2021(2) dt.19-07-2022 2/2 Learned counsel appearing for the State opposes the prayer for anticipatory bail and submits that in the dying declaration of the deceased there is specific allegation against petitioner No.1 that she put kerosene oil on the body of deceased and set her on fire.

Taking into consideration the aforesaid fact, prayer for anticipatory bail of petitioner No.1 is rejected. Considering the facts and circumstances of the case, let the petitioner No.2, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, Sheohar in connection with Purnahiya PS case No.115/ 2021, subject to conditions laid down u/s 438(2) of the Cr. P. C. (Prabhat Kumar Singh, J) BKS/- U T
