JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Two live cartridges are said to have been recovered from conscious possession of the petitioner. So far as recovery of A.K.-56 rifle is concerned, the same has been recovered from conscious possession of the co-accused Suraj Choudhary. No doubt, petitioner does have criminal antecedent but it appears that earlier petitioner was made accused in five cases but almost all the cases had been lodged against him between the year 2003 to 2005 and, after that, except the present case, no other case has been lodged against him.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of the

Patna High Court Cr.Misc. No.29506 of 2016 (2) dt.26-07-2016 2/2 period of detention of the petitioner in jail custody since 22.11.2015, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Ballia P.S.Case No. 370 of 2015.
