JUSTICE RAVI RANJAN ORAL ORDER 09-08-2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case registered for the offence punishable under Section 414 of the Indian Penal Code and Sections 41, 42 and 52 of the Indian Forest Act. It is contended that 206 pieces of 'Khair' wood, one tractor alongwith trailer were recovered from the field of coaccused Krishan Kuer, however, the petitioner has no concern with the alleged recovery rather it belongs to one Rajoo Patel, who had unloaded the same in the field of the petitioner as his tractor developed some mechanical trouble. It is urged that the said Raju Patel had filed an application before the court of Chief Judicial Magistrate, Motihari for release of his 'Khair' wood. It is claimed that antecedent of the petitioner is clean.

Case No.198 of 2014, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran subject to the conditions as laid down under subsection (2) of Section 438 of the Code of Criminal Procedure.
