2. The petitioner seeks bail in connection with Special Case No. 217 of 2023 arising out of Nadi P.S. case No. 340 of 2023 registered for the offence under Section 8/20(b)(ii) (B) of the NDPS Act.
3. As per the prosecution case, the recovery is of 4 Kg of Ganja.
4. The petitioner is in custody since 19.05.2025.
5. It has been submitted by the learned counsel for the petitioner that the petitioner was not caught on the spot. He further submits that the petitioner has clean antecedent.
6. Considering the aforesaid facts, this application is allowed.
7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of
Patna High Court CR. MISC. No.53371 of 2025(3) dt.15-10-2025 2/2 the learned Sessions Judge/Special Judge, NDPS Act, Patna/concerned Court below in connection with Special Case No. 217 of 2023 arising out of Nadi P.S. Case No. 340 of 2023.
8. As a condition of this order, the petitioner after being released on bail is directed to mark his attendance at Nadi (Fatuha) Police Station on first Sunday of each month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner.
9. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.
10. As the petitioner claims to have clean antecedent, the Court below, before accepting the bail bonds of the petitioner is directed to verify the antecedent of the petitioner. If the petitioner is found to be involved in any other case then the bail bonds of the petitioner shall not be accepted. (Sandeep Kumar, J) Vikas/- U
