The petitioner is in custody in a case registered under Section 364(A) IPC.

It is alleged by the informant that his son Guddu went to prayer for Namaz but he did not return. Informant searched everywhere. Then he came to know that his son was seen near Chhata Masjid with one unknown person. It has been submitted on behalf of the petitioner that the petitioner is in custody since 27.03.2016. Charge sheet has been submitted in this case. The petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. Patna High Court Cr.Misc. No.32408 of 2016 (3) dt.30-09-2016 2/2 recorded under Section 164 Cr.P.C. Same is Annexure 3 to the present application. He has denied the allegation of abduction. Subsequently vide Annexure 2 to the present application, the informant has filed a petition in the court below stating that the case was instituted due to mistake of fact.

On behalf of the State it is submitted that the petitioner is not named in the FIR.

Considering the aforesaid facts and circumstances of the case, let above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.,Gaya, in connection with Civil Line P.S.Case No.115 of 2016.
