The petitioner apprehends his arrest in Baikunthpur P.S. case No. 249 of 2018 registered under Section 341, 323, 325, 307, 447, 379, 504/34 of the IPC.

The informant alleged that on 28.08.2018 he was sitting at his Darwaja and asking the wellness of his brother and mother but in the meantime his neighbours, Sanjay Rawat, the petitioner, Niraj Kumar, Pravin Kumar, Seema Kunwar, Pramila Devi, Sumitra Kunwar and Mintu Devi, having armed with different weapons, came and began to wield their weapons. Sanjay Rawat assaulted the informant with Lathi on his head. The learned counsel for the petitioner submits that the occurrence took place on 28.08.2018 but the FIR was lodged on 21.09.2018. The informant got three injuries out of which two

No.51525 of 2019(2) dt.20-08-2019 2/2 are on head but all the injuries are simple in nature and for the treatment of the aforesaid injuries the informant was not admitted for three weeks. The petitioner is next door neighbour of the informant and on account of some petty dispute some scuffle took place.

Considering the facts aforesaid and nature of allegation made against the petitioner, the petitioner, above named, in the event of his arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sri Rakesh Mani Tiwary, learned Judicial Magistrate, 1st class, Gopalganj in connection with Baikunthpur P.S. case No. 249 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
