JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-11-2017 The petitioner seeks regular bail in connection with Agion (G) P.S. Case No. 86 of 2015, registered for offences punishable under Sections 324, 307, 302/34 of Indian Penal Code. Earlier prayer for bail of the petitioner was rejected vide order dated 30.01.2017 passed in Cr. Misc. No. 55188 of 2016. It has been submitted on behalf of the petitioner that petitioner has been in judicial custody since 20.08.2015 and uptil now out of fourteen witnesses only eight witnesses have been examined and there is no likelihood of conclusion of trial in near future.

Having heard both sides, in view of the facts that earlier the prayer for bail of the petitioner was rejected on merit, as such,
Patna High Court Cr.Misc. No.49960 of 2017 (2) dt.08-11-2017 I am not inclined to release the petitioner on bail, this However, considering the fact that petitioner has been in custody for last two years, the trial court is directed to expedite the trial and try to conclude it within a period of six months even by conducting the trial on day to day basis.
At the same time, S.P. Bhojpur is directed to ensure the production of witnesses in the trial court on the date fixed so that the trial can be concluded within the aforesaid period. The above direction must be complied with strictly. (Vinod Kumar Sinha, J) sunil/- U T
