2. Learned counsel for the petitioner submits that the petitioner herein (informant) has filed the present application for seeking cancellation of bail earlier granted to the Opposite Party No. 2 vide order dated 12.05.2025 passed in Cr. Misc. No. 83963 of 2025 in connection with Kishanpur P.S. Case No. 172 of 2021, lodged on 08.09.2021 under Section 138 of N.I. Act.

3. Learned counsel for the petitioner (informant) submits that the amount in question was received in connection with a land transaction. He further submits that a sympathetic view may kindly be taken, and if this Hon'ble Court is pleased

Patna High Court CR. MISC. No.60034 of 2025(2) dt.26-09-2025 2/2 to issue notice in this matter, there is a likelihood of an amicable settlement between the parties.

4. Learned APP for the State submits that the Opposite Party No. 2 has been made accused of under Section 138 of the N.I. Act.

5. Upon perusal of the order dated 12.05.2025 passed in Cr. Misc. No. 83963 of 2024, it transpires to this Court that there is no suppression of material facts.

6. In view of the facts and circumstances of the present case and the submissions made hereinabove, this Court is not inclined to cancel the bail granted to Opposite Party No.

2. Accordingly, the present application seeking cancellation of bail stands rejected.
