JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-08-2017 The petitioner seeks regular bail in connection with Mahila P.S. Case No. 29 of 2017, registered for offences punishable under Sections 376 and 506 of the Indian Penal Code and Section 6 of POCSO Act.
Allegation against the petitioner is of committing rape on the daughter of the informant.
It has been submitted on behalf of the petitioner that he has falsely been implicated in this case due to some dispute and he is next door neighbour of the informant and further there is delay of ten days in lodging the F.I.R. He has been in custody since 29.04.2017.
Learned counsel for the State opposed the prayer for bail. Having heard both sides, considering the fact and
Patna High Court Cr.Misc. No.40059 of 2017 (2) dt.23-08-2017 circumstances of the case and serious nature of allegation, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.
