JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 05-07-2022 Heard learned counsel for the petitioner and learned counsel for the State and perused the case diary. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 323, 324, 376, 511, 354, 307 and 379 of the Indian Penal Code and Sections 6, 7 and 8 of the POCSO Act.

It is a case of outraging the modesty and committing to attempt of rape of the informant.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. Petitioner has got clean antecedent.

Learned APP appearing for the State has opposed the prayer for anticipatory bail and submitted that from the case diary, it appears that this petitioner has outraged the modesty of

No.65879 of 2021(3) dt.05-07-2022 2/2 the informant and torn her clothes after consuming the alcohol by this petitioner and the victim has supported the prosecution case in her statement recorded under Section 164 of the Cr.P.C. Considering the aforesaid facts and circumstances of this case, I am not inclined to grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner is rejected.
