2. The present application has been filed for restoration of C.W.J.C. No.1095 of 2015, which came to be dismissed by a Bench of this Court long back on 10.04.2018 on account of non prosecution.

3. Learned Advocate for the petitioner submitted that

Patna High Court MJC No.2675 of 2024(5) dt.31-10-2025 2/2 the cause of action still survive and in case the present application is not allowed, serious prejudice shall be caused to the entitlement of the petitioner, besides other grounds taken in the restoration application.

4. In view of the submissions advanced and the grounds raised in the restoration application, the same stands allowed.

5. C.W.J.C. No.1095 of 2015 is restored to its original file subject to payment of a cost of Rs.1000/- to be deposited with the Patna High Court Legal Services Committee. (Harish Kumar, J) rohit/- U
