The petitioner seeks bail in connection with special P.S. Case No. 61 of 2014 arising out of Fatuha P.S. Case No. 273 of 2014 registered under diverse provisions of the Arms Act, section 399,402 IPC as well as 20/22 of the NDPS Act. On getting confidential information it is alleged that the police raided a 'Dhaba' where one Bolero was standing. Seeing the police party it is alleged that obstruction was offered by the accused persons whereafter they retreated. On chase, nine accused persons including the petitioner are said to have been arrested. From their possessions one country made pistol and live cartridges were allegedly recovered. The contention of the petitioner is that he is in custody since 14.08.2014. Other accused persons having identical allegations have since been released on bail. Patna High Court Cr.Misc. No.15458 of 2015 (2) dt.07-07-2015 2/2 Cr. Misc. Nos.9194 of 2015 and 12654 of 2015 and its other analogous cases have been produced for perusal. It is submitted that after the arrest the petitioner is said to have made confessional statement on the strength whereof he has been remanded in few other criminal cases.

In the facts and circumstances of the case, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction Addl. Sessions Judge XI, Patna in Special Case No. 61 of 2014 arising out of Fatuha P.S. Case No. 273 of 2014 on condition that one of the bailors shall be own/close family member of the petitioner. As soon as the charges are framed, the petitioner shall appear in person on each date fixed at the trial. In case of default in doing so on two consecutive dates, the trial court shall cancel his bail bonds. (Kishore Kumar Mandal, J) HR/- U T
