Public Prosecutor for the State assisted by learned counsel for the informant.

Petitioner seeks bail in a case registered under sections 307, 120B/34 of the Indian Penal Code and 27 of the Arms Act. According to the prosecution case itself, it was co- accused Raushan Yadav who opened fire on the informant and so far as the petitioner is concerned, it is only stated that he was also present on the place of occurrence along with co- accused Raushan Yadav. Moreover, petitioner is in jail custody since 3.2.2016 and investigation against him appears to have already been completed. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate, Birpur in Raghopur P.S. Case no. 30/2016.
