JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 47(A) of Excise Act.

600 litres sprit kept in three drums were recovered from the backside of house of the petitioner. Petitioner was neither caught on the spot nor anything was recovered either from his house or from his conscious possession. Moreover, petitioner does not have any criminal antecedent and is languishing in jail custody since 22.04.2016.

Considering the aforesaid facts and circumstances as

No.31868 of 2016 (2) dt.24-08-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in connection with Kotwa P.S. Case No. 33 of 2015.
