The petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of the Bihar Excise & Prohibition Act, 2016 in connection with Jagdishpur P.S. Case No. 143/2017.

Allegation against the petitioner is of recovery of 35 litres country made liquor and also 150 litres of mahua pass from his possession.

Submission of the learned counsel for the petitioner is that the seizure list does not disclose the recovery of mahua pass, rather it discloses the recovery of 35 litres country made liquor only. Further, the petitioner is in custody since 05.06.2017 having

Heard learned Additional Public Prosecutor also. Having heard both sides, in view of the facts, stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge IV, Ara in connection with Jagdishpur P.S.
