The petitioner is in custody since 05.04.2017 in connection with Shyampur P.S. Case No. 81 of 2016 for the offence registered under Section 395 of the Indian Penal Code. Learned counsel for the petitioner submits that though the allegation do not make out a case suggesting involvement of the petitioner yet his name has surfaced only on the statement made before the police by co-accused, which has no evidentiary value. It is further submitted that similarly situated coaccused has since been extended the privilege of regular bail vide order dated 03.08.2017 passed in Cr. Misc. No. 34826 of 2017. It is further submitted that petitioner has not been put on T.I. Parade and the alleged Sari produced as article of T.I. parade was never

Patna High Court Cr.Misc. No.40604 of 2017 (3) dt.20-09-2017 2/2 said to be stolen in the FIR. As such, the petitioner may be extended the privilege of bail.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Sheohar in connection with Shyampur Bhataha P.S. Case No. 31 of 2016 corresponding to G.R. No. 716 of 2016.
