Mr. Sri Shyameshwar Dayal ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 08-08-2018 The petitioner has prayed for modification of the order dated 04.01.2016 passed by a Bench of this Court in Cr. Misc. No. 30799 of 2016.

By the aforesaid order, the petitioner was granted anticipatory bail subject to his surrendering before the court below within a period of five weeks from the date of passing of the order in connection with Bhagwanpur P.S. Case No. 72 of 2012.

Learned counsel for the petitioner has submitted that he had out of the country and therefore he could not surrender on time.

Hence, a prayer for extension of time / modification of the order dated 04.10.2016 has been made.

Patna High Court Cr.Misc. No.47667 of 2018(2) dt.08-08-2018 2/2 Looking at the background facts of the case, the order dated 04.10.2016 is modified to the extent that if the petitioner surrenders before the court below within a period of four weeks from today, he shall be released on bail on his furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan in connection with Bhagwanpur P.S. Case No. 72 of 2012.

The other conditions imposed by the order dated 04.10.2016 shall however subsist.

The petition is allowed and the order dated 04.10.2016 is modified accordingly.
