JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 5.11.2015 and according to the prosecution case itself, the petitioner is motherin-law of the deceased. The accusation against the petitioner is that she along with other nine F.I.R named accused caused injuries on both hands and legs of the deceased, as a result of which deceased died but before his death, he disclosed the name of petitioner and others before the informant, as claimed by the informant in his written report.

Submission on behalf of the petitioner is that only two injuries on both wrists of the deceased were found and the aforesaid injuries are not attributed to the petitioner. Moreover, co-

Patna High Court Cr.Misc. No.29976 of 2016 (2) dt.04-08-2016 2/2 accused Binod Singh, who happens to be cousin father-in-law of the deceased and is very much named in the first information report, has already been granted privilege of bail by a co-ordinate Bench of this Court.

Considering the aforesaid facts and circumstances as well as submissions of the parties and particularly taking note of this fact that petitioner being lady is languishing in jail custody since long and investigation against her has already been completed, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st class, Danapur, Patna in connection with Bikram P.S.Case No. 78 of 2015.
