The petitioner seeks bail in a case registered under Sections 147, 148, 149, 323, 324, 341, 342, 109, 114, 307, 302 of the Indian Penal Code.

Prosecution case, in short, is that on the alleged date of occurrence the informant along with his cousin brother Bali Yadav and own brother Sitaram Yadav were going to the house of Sitaram Yadav. On the way the accused persons variously armed caught hold of the informant and his two brothers. The informant and cousin brother Bali Yadav escaped, but the accused persons and 100 unknown killed the brother of the informant Sitaram Yadav.

It has been submitted on behalf of the petitioner that

Patna High Court CR. MISC. No.52949 of 2019(2) dt.23-08-2019 2/2 the petitioner is in custody since 1.4.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. General and omnibus allegation has been made. No specific injury has been attributed against the petitioner. Other co-accused has been graned bail vide Annexure 2 to the present application.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Gaya in connection with Bodh Gaya P.S. case No.67 of 2013.
