JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail in a case registered for the offences punishable under Section 370A/34 of the Indian Penal Code, Sections 3, 4, 5, 6 and 9 of The Immoral Traffic (Prevention) Act and Sections 4 and 6 of Protection of Children from Sexual Offences Act.

It is alleged by the informant that her parents died leaving behind her under the guardianship of the petitioner but as soon as the informant attained the age of 11-12 years, the petitioner and co-accused Shahnawaz Alam forced her for flesh trade.

It is submitted by learned counsel for the petitioner that in 164 Cr. P.C. statement, the victim has not alleged anything against the petitioner and said that she is like her mother. A

Patna High Court Cr.Misc. No.14918 of 2015 (2) dt.05-05-2015 2/2 statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on bail, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Addl. Sessions Judge-cum-Special Judge, Araria in connection with Mahila P.S. Case No. 53 of 2014 arising out of Spl. Case No. 06/11/14.
