The petitioner is apprehending his arrest in connection with Khdawan P.S.Case No.7 of 2018 and G.R.No.137 of 2018 registered for offences punishable under Sections 379/34 of the Indian Penal Code.
Allegation against the petitioner is of commission of theft of a Tractor of the informant and the petitioner is said to be driving the said Tractor.
Submission of the learned counsel for the petitioner is that for that two cases have been lodged and in one case he has been granted bail by this Court.
Heard learned A.P.P. also.
Having heard both sides and in view of the fact that there is
Patna High Court Cr.Misc. No.46068 of 2018 (2) dt.09-08-2018 2/2 specific allegation that he was driving the stolen tractor, I am not inclined to grant anticipatory bail to the petitioner rather let the petitioner surrender before the learned court below within a period of four weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below on its own merit.
With the aforesaid direction, this application is dismissed. (Vinod Kumar Sinha, J) chn/- U T
