Petitioner is apprehending his arrest in connection with Complaint Case No.2600 of 2018 , registered for offences punishable under Sections 498A of the Indian Penal Code and Section 4 of the D.P.Act.
Petitioner happens to be husband of the informant and there is allegation against him of subjecting her to cruelty and assault with respect to demand of one Scorpio . Submission of the learned counsel for the petitioner is that both the parties are government teacher and they have son also. Allegation is false and concocted and he is still ready to keep her with dignity and care.
Patna High Court CR. MISC. No.52632 of 2019(4) dt.06-11-2019 2/2 Ont he other hand the learned counsel for the O.P.no.2 has submitted that as she was subjected to severe assault, as such she is not ready to reside with petitioner rather she is interested in one time settlement.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Araria in connection with Complaint Case No.2600 of 2018, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
