JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 354(D), 504, 509, 34 of the Indian Penal Code and Sections 11, 12 of POCSO Act. Petitioner and co-accused, Rohit Paswan, allegedly, used to tease the informant's minor daughter and on the alleged date of occurrence, it was co-accused, Rohit Paswan, who stopped the victim while she was on her way and asked her to pick up her phone.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with

Patna High Court Cr.Misc. No.30803 of 2016 (2) dt.09-08-2016 2/2 two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge-cum-Special Judge (POCSO), Gaya in connection with Sohail P.S. Case No. 11 of 2016 corresponding to POCSO Case No. 19 of 2016, subject to condition that any attempt on behalf of the petitioner to terrorize the prosecution witnesses or to tamper with the prosecution evidence shall give liberty to trial court to cancel the bail bonds of the petitioner after due and proper enquiry.
