This is an application for bail in connection with Shakurabad P.S.Case No. 137 of 2014 registered for the offences punishable under Sections 147, 148, 384, 385 of the Indian Penal Code and 17 of C.L.A. Act.

Petitioner is not named in the FIR and later on his name transpires during course of investigation on the basis of confessional statement of co-accused.

Submission of learned counsel for the petitioner is that except confessional statement there is nothing against him and there is no recovery from his possession and he is in custody since 1.8.2017. Further submission is that he has been made accused in one more case and he has been granted bail in that case. Further

Patna High Court Cr.Misc. No.46594 of 2017 (2) dt.21-09-2017 2/2 submission is that co-accused has been granted anticipatory bail by this Court in Cr.Misc.No. 12597 of 2017, vide order dated 11.7.2017.

Having heard both sides and in view of the facts and circumstances, this application is disposed of with a direction to the court below that once charge sheet has been submitted in this case and if there is nothing found against the petitioner, the court below will release the petitioner on bail to its own satisfaction.
