2. Counsel for the Nagar Panchayat submits inspite of the fact that copy has been served upon him and he is a panel counsel, his name has not figured in the cause list, but he is here to defend this case.

4. Counsel for the petitioner submits that the present writ application has been filed directing the respondent authorities to assign the petitioner on compassionate ground in Nagar Panchayat, Revilganj, Saran at Chapra.
5. Counsel further submits that father of the petitioner was working on the post of Sweeper in Nagar Panchayat, Revilganj being a permanent employee. He was appointed on 13.02.1991 and due to heart attack, he died on 16.06.2019 after rendering his service 28.5 years.

Counsel further submits that fulfilling all paraphernalia, the petitioner has filed the application for compassionate appointment and in this regard, respondent No.8 (the Executive Officer, Nagar Panchayat, Revilganj, Saran at Chapra) has made communication variously, but till date no positive result has come forward. He further submits that from the letter issued by the Executive Officer, it transpires that the mother of the petitioner has been recommended before compassionate committee constituted for appointment on compassionate ground headed by District Magistrate, Saran which is letter No.611 dated 21.04.2023 and letter No.457 dated 10.03.2023.

7. Counsel for the State submits that in this regard, a decision has to be taken at the level of competent authority.
8. Counsel for the Nagar Panchayat submits that recommendation at the level of Nagar Panchayat has been made.
9. In this view of the matter, the present writ petition is hereby disposed off directing the District Magistrate, Saran who is chairman of the Bihar Compassionate Committee to place case of the petitioner in the committee to take decision and pass a reasoned and speaking order in accordance with law within 90 days from the date of production of this order.
10. With the aforesaid direction, the present writ petition stands disposed off.
