This is an application for bail in connection with Kargahar P.S.Case No. 168 of 2017 registered for the offences punishable under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act.

Petitioner is named in the FIR and allegation against accused persons, including the petitioner is of firing on the father of informant and due to which he died at the spot. Submission of learned counsel for the petitioner is that petitioner is innocent and has committing no offence and informant was not present at the time of occurrence and the case is false and concocted. Further submission is that petitioner is in custody since 19.7.2017 having no criminal antecedent.

Having heard both sides and in view of the facts and circumstances, this application is disposed of with a direction to the court below that once charge sheet has been submitted in this case and if there is nothing found against the petitioner, the court below will release the petitioner on bail to its own satisfaction.
