JUSTICE PRABHAT KUMAR JHA ORAL ORDER 31-03-2015 Since both the cases have arisen out of one occurrence, they are being disposed of by this common order. Heard both sides.

The petitioners seek bail in Muffasil P.S. Case No. 169 of 2014, registered for the offences punishable under different Sections of the Arms Act.

Patna High Court Cr.Misc. No.4905 of 2015 (4) dt.31-03-2015 2/2 The police disclosed that the petitioners fled away after throwing bag and on chase the petitioners were apprehended and from the bag 8 pieces of semi-constructed pistols were recovered. Learned counsel for the petitioners submits that nothing has been recovered from the conscious possession of the petitioners. From perusal of the seizure list, it would appear that the police did not obtain the signature of the petitioners on the seizure list even the bag was recovered from the side of the road. It appears that the seizure list does not bear the signature either of the petitioners. Eight semi-constructed pistols were recovered by the side of the road. The petitioners are alleged to have thrown the bag. The petitioners have got no criminal antecedent.

Considering the facts aforesaid, the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate, Munger in connection with Muffasil P.S. Case No. 169 of 2014.
