The petitioner being the husband of the informant is languishing in custody since 9.5.2016 in a case registered for the offences punishable under sections 341, 323, 307, 498A, 506, 504, 120B/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.
The basic accusation is of torture for non-fulfillment of dowry demands after nine months of the marriage, making assault to the informant and causing burn injury.
It is submitted by the learned counsel for the petitioner that the father of the petitioner filed Complaint Case No. 488C/2016 on 2.3.2016 against the informant's family levelling accusation of kidnapping of the petitioner which came to be registered as Araria P.S.Case No. 189/2016, wherein it has been alleged that the petitioner was
Patna High Court Cr.Misc. No.30389 of 2016 (2) dt.26-07-2016 kidnapped on 25.7.2015 for the purpose of marriage and thereafter the present F.I.R. was registered on 25.4.2016. Considering the nature of accusation, the case filed by the petitioner's side at the earlier point of time and the period under custody, let the petitioner, abovenamed, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in Araria (Bairgachhi) P.S.Case No. 226/2016.
