1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 325, 307, 379, 504, 506, 34 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that on 01.09.2022 at about 6 P.M. her brother-in-law (petitioner) came and started abusing, on protest, petitioner along with Radha Devi and Bindiya Kumari started assaulting with lathi, danda, on account of which, she sustained injury on head, thereafter petitioner again assaulted with lathi, on account of which, she sustained injury on her right hand, thereafter the accused persons also assaulted her husband and Bindiya
Patna High Court CR. MISC. No.54319 of 2025(4) dt.11-11-2025 2/3 snatched Mangalsutra of the informant.
4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that husband of the informant is own brother of the petitioner and are having land dispute. It is next submitted that on account of dispute relating to property an altercation took place in which both side assaulted each other. It is further submitted that from side of the petitioner Ganga Bridge P.S. Case No.223/2022 has been instituted against the informant and his side. It is also submitted that one of the injury of the informant is opined to be grievous but then the same is on hand which is not vital part of the body and allegation of assault is also not specific. It is further submitted that petitioner is not a criminal.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount
Patna High Court CR. MISC. No.54319 of 2025(4) dt.11-11-2025 3/3 each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Ganga Bridge P.S. Case No.221/2022, subject to the conditions as laid down under Section 482(2) B.N.S.S.
