This is an application for bail in connection with Ara Town P.S.Case No. 116 of 2017 registered for the offences punishable under Sections 307 of the Indian Penal Code and 27 of the Arms Act.
Petitioner is named in the FIR and as per FIR, three accused persons, including the petitioner have chased the informant and they have fired causing injury to him. Submission of learned counsel for the petitioner is that no specific allegation of firing is attributed against him and though injured has stated that petitioner has fired but that did not hit him and further submission is that he is in custody for five months having no criminal antecedent.
Patna High Court Cr.Misc. No.36770 of 2017 (3) dt.30-08-2017 2/2 Heard learned APP also, who has opposed the prayer for bail.
Having heard both sides and in view of facts and circumstances of the case, I am not inclined to grant bail to the petitioner at this stage.
However, learned court below is directed to release the petitioner on bail once charge has been framed in this case against the petitioner and other accused persons to its own satisfaction. With the above observation, this application is disposed of.
