Petitioner seeks bail in a case registered under section 302/34 of the Indian Penal Code.

No doubt, petitioner happens to be elder brother-in-law of the deceased and there is some delay in lodging the first information report but para 3 of the original case diary goes to show that statement of the deceased was recorded by police at M.J.K. hospital, Bettiah on 8.11.2011 and in the said statement, she, specifically, stated that the petitioner and other accused poured kerosene oil and lit fire on her body.

Therefore, considering the above stated statement of the deceased as well as facts and circumstances of the case, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Bairiya P.S. Case no. 196/2011 pending in the

Patna High Court Cr.Misc. No.30753 of 2016 (4) dt.08-11-2016 court of the Chief Judicial Magistrate, Bettiah, West Champaran stands rejected.
