JUSTICE SATYAVRAT VERMA ORAL ORDER 01-04-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402, 413, 420, 467, 472, 414 of the Indian Penal Code read with Sections 25(1-B), 25(1-AA)a, 26(i)(ii) and 35 of the Arms Act.
Learned counsel for the petitioner submits that the petitioner is in custody since 14.07.2021, is a person with clean antecedent and charge-sheet has been submitted. Allegation is of recovery of one country made loaded pistol along with five live cartridges from the possession of the petitioner and country made Musket, 14 live cartridges along with other articles from the house of the petitioner.

From perusal of the allegation as alleged in the FIR, it would manifest that one of the accused had fled away and while fleeing thrown the arms and ammunitions and this petitioner came to be implicated showing the alleged recovery of the thrown arms and ammunitions from his possession. It is also submitted that petitioner is a person with clean antecedent and has remained in custody more than eight months.
Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.
Considering the fact that the petitioner is in custody since 14.07.2021, is a person with clean antecedent and chargesheet has been submitted and it is the first offence of the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Mojahidpur P.S. Case No. 182 of 2021, subject to the condition that one of the bailors shall be the cousin brother (Md. Aftab Alam) of the petitioner and further if the petitioner is implicated in a case of similar nature then the learned court
