====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 12-04-2022 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in connection with Bihariganj P. S. Case No. 98 of 2021, instituted for the offences under Sections 392 of the Indian Penal Code.

The learned counsel for the petitioner submits that the petitioner is in custody since 18.06.2021, charge-sheet has been submitted and has antecedent of six cases. The learned counsel for the petitioner further submits that the informant alleges that he was intercepted by two unknown criminals who on point of gun looted rupees 81900/- along with a bag which contained articles as detailed in the FIR. Learned counsel for the petitioner submits that FIR was against unknown and the name of this petitioner came on his confessional statement when he was arrested in Bihariganj P.S. Case No. 77 of 2021. Learned counsel for the petitioner further submits that despite being remanded in the present case

Patna High Court CR. MISC. No.65867 of 2021(2) dt.12-04-2022 2/2 he was never put on TIP and he has been made accused in the present case only because of his antecedent.

Learned A.P.P. opposes the bail application by submitting that petitioner has antecedents of six cases. Considering the fact that the petitioner is in custody since 18.06.2021, charge-sheet has been submitted and has never been put on TIP, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned J.M.1st Class, Udakishunganj, Madhepura in connection with Bihariganj P.S. Case No.98 of 2021. The petitioner shall be released after framing of charge.
