JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-03-2015 Heard learned counsel for the petitioner as well as leaned Additional Public Prosecutor for the State. The accusation against the petitioner is that he gave Farsa blow to the son of informant causing injury on his head but injury report of the son of the informant reveals that he sustained injury on his vertex. The doctor has opined that the aforesaid injury was grievous in nature but it appears to me that the doctor gave the aforesaid opinion on the ground that the said injury was dangerous to the life. Moreover, the alleged occurrence is said to have taken on account of land dispute.

Considering the aforesaid facts and circumstances as well as submission of the parties, let the petitioner named above,

Patna High Court Cr.Misc. No.12438 of 2015 (2) dt.26-03-2015 be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Harsidhi P.S. Case No. 265 of 2013 to the satisfaction of Smt Sangita Rani, Judicial Magistrate-Ist Class, Sadar, Motihari, East Champaran.
