JUSTICE SANJAY PRIYA ORAL ORDER 15-11-2017 Learned counsel for the petitioner has submitted that the petitioner is in custody since 13.03.017. Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 08.05.2017 passed in Cr. Misc. No. 20906/2017 on the ground that five other excise cases are pending against him. The petitioner was given liberty to renew his prayer for bail after six months if no substantive progress is made in the trial.
The petitioner has again moved for bail.
The report was called from the court below which has been received. The court below has mentioned in the report that charge has not been framed in the case till date. There is allegation of recovery of 25 litres of country made liquor from
Patna High Court Cr.Misc. No.48939 of 2017 (3) dt.15-11-2017 2/2 possession of the petitioner kept in a bag on the motorcycle. In such circumstances, keeping in view the period of custody of the petitioner and the fact that charge has not been framed against the petitioner till date, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional District & Sessions Judge, Sheikhpura in connection with Mehus P.S. Case No. 06/2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
The petitioner will file affidavit in the court below at the time of release that he will not indulge himself in such type of cases after being released on bail in this case and in the event he is found involved in such type of cases after being released on bail his bail bond will be liable to be cancelled.
