JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-03-2015 Heard learned counsels for the petitioner and the State. The petitioner being the uncle of the husband of the victim is languishing in jail since 06.12.2014 in a case registered for the offences punishable under Sections 304B/34 of the Indian Penal Code.

The accusation is of killing the sister of the informant for non-fulfilment of the dowry demand.

It is submitted by learned counsel for the petitioner that admittedly the marriage was performed on 30.04.2002 and the victim died in the year 2014 and on conclusion of the investigation, chargesheet has been submitted under Sections 302 and 201/34 of the IPC. Moreover, the father of the husband of the informant has been granted bail by this Court vide Cr. Misc. No. 3662 of 2015.

No.7486 of 2015 (2) dt.03-03-2015 2/2 Considering the aforesaid facts, let the above named petitioner be released on bail, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Raxaul, East Champaran at Motihari in connection with Raxaul P.S. Case No. 249 of 2014.
