JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-07-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Sections 399 and 402 of the Indian Penal Code and Sections 25(1B)/26/35 of the Arms Act. Petitioners and one other accused were caught on spot whereas some accused persons are said to have managed to escape from there. On search, one country made loaded Katta was recovered from possession of co-accused Raju. So far as petitioners are concerned, nothing was recovered from their conscious possession.
Submission on behalf of the petitioners is that when
Patna High Court Cr.Misc. No.29575 of 2016 (2) dt.26-07-2016 2/2 petitioners were apprehended in the present case, they were remanded in some other cases.
Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioners are in jail custody since 30.3.2016, let the petitioners above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of A.C.J.M.-6, Saran, Chapra in connection with Nayagaon P.S.
