The petitioner seeks bail in connection with Sahiyara P.S. Case No.37 of 2016 registered under Sections 272 and 273 of the Indian Penal Act besides Sections 47(A) and 51 of the Bihar Excise Amendment Act.
The accusation is of recovery of 21 bottles, each containing 300 ml. Nepali Liquor, from the house of the petitioner. Learned counsel appearing on behalf of the petitioner submits that the alleged recovery are said to be made from the house of the petitioner nor from the conscious possession of the petitioner. Patna High Court Cr.Misc. No.27602 of 2016 (3) dt.14-07-2016 2/2 custody since 06.04.2016.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, in connection with Sahiyara P.S. Case No.37 of 2016.
