Lal, learned counsel for the petitioner and Mr. Sarvottam Kumar, learned counsel representing the informant beside Mr. Jitendra Kumar Singh, learned APP.

2. The petitioners are apprehending their arrest in connection with Nimachandpura P.S. Case No. 90 of 2024 registered for the offence punishable under Sections 115(2), 126(2), 329(4), 109, 303(2), 351(2), 352 and 3(5) of the Bharatiya Nyaya Sanhita, lodged on 02.11.2024 by the informant Bhago Devi.

3. As per the prosecution story, the informant alleged

No.57592 of 2025(2) dt.10-09-2025 2/3 that alleging the informant side to be indulging in witchcraft and calling her 'dayan' not only they assaulted the family members, also tried to feed her excreta. When the daughter-in-law came to rescue, she was assaulted causing injury on the nose of Anjani Devi, Chhotu Sahni also assaulted the said daughter-in-law and other family members. The injured were shifted to the hospital. This led to the F.I.R.

4. Learned counsel for the petitioners submit that there is case and counter case, both sides have narrated the same story, these petitioners do not have criminal antecedent.

5. On the other hand, learned counsel representing the informant has taken this Court to the learned Sessions Judge order to show that the injury has been found to be grievous in nature as the nose bone got broken. Further, they also tried to act in an inhumane way and the said daughter-in-law is battling for life.

6. Considering the submissions of the parties as also the materials on record, beside the fact that the injury has been found to be grievous in nature attributed to these petitioner, it is unfortunate that even in the 25th Year of the 21st Century, the people are assaulting the innocent persons claiming that they indulge in witchcraft, no relief can be granted to these petitioners.

7. Accordingly, the anticipatory bail application stands rejected.
