JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-07-2018 Heard the parties. The petitioner seeks anticipatory bail in connection with Lalganj P.S. Case No.05 of 2013, registered for offences punishable under Sections 420, 467, 468, 471 and 120 (B) of the Indian Penal Code.
As per F.I.R., a raid was conducted on the instruction of Senior Manager of Punjab National Bank, Hazipur by the police force along with senior officers of Punjab National Bank, Muzaffarpur and searched one Sanjay Agrawal at Lalganj Gadhi Chowk, where the forged name of Punjab National Bank I.V.M. was running and other persons were also apprehended with other articles from the said Bank.
Submission of the learned counsel for the petitioner is
Patna High Court Cr.Misc. No.44617 of 2018 (2) dt.31-07-2018 2/2 that the petitioner has falsely been implicated in this case and the petitioner is not named in the F.I.R. and the co-accused persons have already been granted regular bail by Co-ordinate Benches of this Court vide order dated 18.03.2013 passed in Cr. Misc. No. 8624 of 2013 and vide order dated 16.7.2013 passed in Cr. Misc. No. 8633 of 2013. It is also submitted that the petitioner has no criminal antecedent and the petitioner went to the said Bank or I.V.M. for getting job and her resume was lying in the said office. Learned A.P.P. opposes the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named, surrenders be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Lalganj P.S.Case No. 5 of 2013, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
