JUSTICE SUDHIR SINGH ORAL ORDER 06-09-2016 Heard learned counsel for the petitioner, informant and the State.

The petitioner seeks bail in a case instituted under Sections 366A, 363 and 34 of the Indian Penal Code. Allegation against the petitioner is of kidnapping minor daughter of the informant.

It has been submitted on behalf of the petitioner that he is in custody since 4.3.2016. Chargesheet has been submitted against the petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioner. Three persons are named in the F.I.R. Petitioner is not named in the F.I.R. The victim has been recovered. In her statement under Section 164 of the Code of Criminal Procedure, she has admitted that she had travelled with the petitioner in the train but she did not protest at any point of time. The medical examination report (Annexure-2) does not support the allegation made by the victim.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur, in connection with Kalyanpur P.S. Case no. 14 of 2016.
