JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section302 of the Indian Penal Code. No doubt, petitioner is named in the first information report but the informant has raised suspicion against the petitioner only on the ground that in the previous night, the informant had seen the petitioner coming out from house of the deceased. The petitioner was arrested and confessed his guilt but admittedly, neither arm nor any other thing was recovered on the basis of confessional statement of the petitioner. The investigation against the petitioner has already been completed.

Accordingly, petitioner named above, is directed to be

Patna High Court Cr.Misc. No.28097 of 2016 (3) dt.26-09-2016 2/2 released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sahiyara P.S. Case No. 127 of 2015 to the satisfaction of Chief Judicial Magistrate, Sitamarhi.
