JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 16-08-2016 Heard the counsel for the petitioner and the State. The petitioner is a small kiosk owner and sells Pan Masala and Zarda including allied items. It is alleged that duplicate product of Tulsi Zarda was being sold at the shop of the petitioner. He is thus facing accusation punishable under section 420 IPC and sections 63 & 65 of the Copy Right Act. The contention of the petitioner is that he is a small vendor. The sale materials are supplied by different mobile suppliers. It is not the case that he purposely was engaged in selling the duplicate Zarda. During investigation, the police gave him protection under section 41(a) of Cr. PC. He has no criminal antecedents and is ready to abide by the condition of the anticipatory bail.

No.31054 of 2016 (2) dt.16-08-2016 2/2 Considering the facts and circumstances of the case, let the petitioner, above named, in the event of arrest/surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of CJM, Darbhanga in Darbhanga Town Case No. 43 of 2014 on condition that one of the bailors shall be his own/close family member. He shall appear on each date fixed at the trial. In case he skips the appearance on two dates consecutively, his bail bonds shall stand cancelled. (Kishore Kumar Mandal, J) HR/- U T
