JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-08-2017 The petitioner seeks regular bail in connection with Runnisaidpur P.S. Case No. 592 of 2014, registered for offences punishable under Sections 302, 201/34 of the Indian Penal Code. Petitioner is a lady and allegation against her is that she along with others have killed the brother of the informant. It has been submitted on behalf of the petitioner that her name transpired in this case only on the basis of suspicion as earlier, she used to talk with the deceased over phone and except that there is nothing against her. Further earlier the petitioner was granted anticipatory bail till submission of charge-sheet and, thereafter, the petitioner voluntarily surrendered and had not misused the privilege of anticipatory bail and as directed in the anticipatory bail application, she has also fully cooperated in the

investigation of the case. It has also been submitted that now she is on her family way and has been in judicial custody since 05.06.2017.

Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Sitamarhi, in connection with Runnisaidpur P.S. Case No. 592 of 2014, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make herself available as and when required by the court and on the event of failure on her part to appear before the court below on two consecutive dates without showing any genuine reasons, the

prosecution will be free to move for cancellation of her bail bonds.
