The petitioner is widow of late Vishnu Kant Mishra, who died in harness on 26.12.2008.
Learned counsel for the petitioner submits that the husband of the petitioner was entitled for grant of 12.5 % interest on Group Insurance, which was extended to all similarly circumstanced. He further submits that the benefit of pay revision in terms of U.G.C. Pay revision w.e.f. 01.01.2006 to 26.12.2018 is also admissible as the University has granted such benefits to other similarly circumstanced.
Patna High Court CWJC No.16651 of 2019(2) dt.19-08-2019 2/2 Considering the aforesaid, the writ application is disposed of with a direction to the respondent University to examine the record and on verification if it is found that the husband of the petitioner has not been paid the benefit of D.A. & H.R.A. and other allowance, the University shall ensure payment of the same from 01.01.2006 till the date of death of the husband of the petitioner.
Final decision with regard to grant of consequential benefits may be taken by the respondent University within a maximum period of three months from the date of receipt/production of a copy of this order.
During the same period, the University shall examine the record and pay the interest on Group Insurance of the husband of the petitioner, if paid to others. With the aforesaid, the writ application is disposed of. (Anil Kumar Upadhyay, J) uday/- U
