JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-08-2018 The petitioners are apprehending their arrest in connection with Saharsa P.S. Case No. 1238 of 2017, registered for offences punishable under Section 120-B of the Indian Penal Code and Section 20/22 of the N.D.P.S. Act.
Allegation of recovery of 3 kgs. Ganja from the house for the petitioners.
Submission of learned counsel for the petitioners is that as a matter of fact, the petitioner no.1 is a pardanashin lady and she has falsely been implicated in this case. Further submitted that petitioner no.2 is husband of petitioner no.1. Heard learned A.P.P. also who opposed the prayer for bail of the petitioners.
Having heard both sides, so far petitioner no.2 is
Patna High Court Cr.Misc. No.44640 of 2018 (2) dt.01-08-2018 2/2 concerned, I am not inclined to grant privilege of anticipatory bail rather he is directed to surrender before the court below and make prayer for regular bail which would be consider on the merit of the case.
So far petitioner no.1 is concerned, she is directed to surrender in the court below within a period of six weeks and pray for regular bail and the court below shall consider the submission of learned counsel for the petitioner no. 1 and shall pass an appropriate order, if possible on same day.
