JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 22-08-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Kesariya P.S. Case No. 509 of 2018 for the offenses under Sections 341, 323, 324 and 307/34 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner has no criminal antecedent. The petitioner is in custody since 26.4.2019. The police after investigation submitted charge sheet under Sections 341, 323, 325/34 IPC and found the case untrue under Section 307 IPC.

Considering the fact that the police after investigation submitted charge sheet under Sections 341, 323, 325/34 IPC and the petitioner has no criminal antecedent, the court is

Patna High Court CR. MISC. No.51642 of 2019(2) dt.22-08-2019 2/2 inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari, East Champaran in connection with Kesariya P.S. Case No. 509 of 2018.
