17-08-2016 Heard Sri Bishweshwar Ram, learned counsel for the petitioner and Smt. Rita Verma, learned Addl. Public Prosecutor. The sole petitioner, who is in custody only since 31-05-2016 in Mansi P.S. Case No. 87 of 2015, G.R. No. 1072 of 2015, corresponding to Sessions Trial No. 36 of 2016 registered for offence under Section 304(B), 201/34 of the Indian Penal Code, has prayed for grant of bail.
Learned counsel for the petitioner submits that husband of the petitioner, who was father-in-law of the deceased, has already been granted bail by this Court, vide order dated 16-10-2015 passed in Cr. Misc. No. 47315 of 2015. It has been argued that in the F.I.R., there was general and omnibus allegation and once the husband of the petitioner is granted bail, the
Patna High Court Cr.Misc. No.32126 of 2016 (2) dt.17-08-2016 2/2 petitioner deserves same relief.
I have perused the materials on record. Fact remains that F.I.R. was lodged in the month of April,, 2015 and petitioner surrendered on 31-05-2016 i.e. after her husband was released on bail by this Court.
Keeping in view the nature of accusation, I do not find any ground to extend the privilege of bail.
Dismissed.
