2. The petitioner has preferred this application for grant of regular bail in connection with Nawada Cyber P.S. Case No. 33 of 2024, registered for the offences punishable u/s 379, 419, 420, 465, 468, 470, 471 of the Indian Penal Code and under section 66, 66B, 66C, 66D of IT Act.

3. As per the prosecution case, on the disclosure of the co-accused persons, police apprehended the petitioner who was allegedly indulged in Cyber fraud and from his possession, a mobile phone was recovered.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.59925 of 2024(2) dt.03-09-2024 2/2 this case. No incriminating material has been recovered from the conscious possession of the petitioner. The petitioner was not indulged in any crime of cyber fraud. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 14.06.2024. He has also submitted that on similar footing, co-accused Birendra Kumar Verma has been granted bail by a coordinate Bench of this Court vide order dated 28.08.2024 passed in Cr. Misc. No. 58559 of 2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be released on bail on furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Nawada in connection with Nawada Cyber P.S. Case No. 33 of 2024.
